What happened
The Landlord applied to evict the Tenants for non-payment of rent. The Tenants raised several counter-claims under section 82, including lack of access to laundry, discontinuation of internet service, and issues with utility billing. The Tenants also claimed to have made a cash payment that the Landlord did not acknowledge. The Landlord admitted to cutting off the internet but claimed it was a response to harassment. The Member found that the Tenants failed to prove the cash payment but were entitled to abatements for the loss of internet and laundry access.
The ruling
The tenancy is terminated effective June 17, 2025, unless the Tenants pay $18,206.00 to void the order. If they do not pay, they must vacate, and they are ordered to pay the Landlord $7,192.52. This total accounts for rent arrears and filing fees, minus the rent deposit, interest, a $200.00 abatement for laundry access issues, and a $180.00 abatement for the discontinued internet service. The Landlord is also ordered to provide the Tenants with a key to the shared mailbox.
