What happened

Landlords applied for an order to terminate the tenancy and evict Tenants because the Landlords entered into an agreement of purchase and sale of the rental unit and the purchaser in good faith requires possession of the rental unit for the purpose of residential occupation.

The ruling

Landlord's application related to the N12 notice is dismissed as the Landlord failed to pay the required compensation before the termination date. However, the Landlord's request to amend the application to include utilities owing is granted. The Tenants are ordered to pay $4,026.87 for utilities up to March 8, 2024, and $186 for the application filing fee, for a total of $4,212.87. If the Tenants do not pay the full amount by May 27, 2024, they will start owing interest at 7% annually on the outstanding balance.
