What happened

The Landlords applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. By the time of the hearing, the Tenants had already vacated the rental unit on September 30, 2025. The Tenants requested an adjournment to combine this hearing with their own pending T2, T5, and T6 applications, but the request was denied as the Board had previously ruled on the matter. The Tenants also attempted to raise Section 82 issues, which were denied due to a lack of proper disclosure and explanation.

The ruling

The tenancy was terminated effective September 30, 2025. The Tenants are ordered to pay the Landlords $2,188.91 by November 15, 2025. This amount accounts for two months of rent arrears and the filing fee, offset by the last month's rent deposit and accrued interest. If payment is not made by the due date, simple interest of 4% per year will apply.
