What happened
The Landlord applied to terminate the tenancy for non-payment of rent. During the hearing, the parties reached a consent agreement. The agreement stipulates a non-voidable termination of the tenancy effective May 1, 2025. The Tenants are to pay the Landlord $7,652.06 for rent arrears and costs by April 30, 2025. If the unit is not vacated by the termination date, the Landlord can seek enforcement for eviction.
The ruling
By consent, the tenancy is terminated effective May 1, 2025, and this termination is non-voidable. The Tenants are ordered to pay the Landlord $7,652.06 by April 30, 2025. If the Tenants do not vacate the unit by May 1, 2025, the Landlord is entitled to file for an eviction with the Sheriff. Interest at 5.00% will be charged on any outstanding amount starting May 1, 2025.
