What happened
The Landlord applied for eviction and rent arrears against the Tenant. The Tenant had already vacated the unit before the hearing and did not attend, though her representative was present. The representative's request to adjourn and raise a new issue of an illegal lockout was denied due to a failure to disclose the issue in a timely manner. A previously raised maintenance issue regarding mice was considered but dismissed, as the Board found the Landlord's actions to address it were reasonable and the Tenant provided no evidence of an ongoing problem. The tenancy was terminated and the Tenant was ordered to pay the outstanding rent arrears.
The ruling
The tenancy is terminated effective November 16, 2024, the date the Tenant vacated the unit. The Tenant's claim regarding a mice issue was dismissed. The Tenant is ordered to pay the Landlord $9,046.10, which covers rent arrears up to the move-out date and the application fee, less the rent deposit and accrued interest.
