What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to persistent late payment of rent. The Landlord testified that the Tenant was late for the past 14 months and ceased paying rent entirely in July 2025. The Tenant acknowledged late payments but cited noise disturbances (drilling and thumping) and a chemical smell as reasons for wanting to move, though stayed due to financial constraints. The Board found the persistent late payment proven and ordered the termination of the tenancy.
The ruling
The tenancy is terminated effective November 11, 2025. The Tenant is ordered to vacate by this date. While the Tenant is credited for her rent deposit and interest, the total credit exceeds the current daily compensation and filing fees by $540.61. However, the Landlord is authorized to deduct ongoing daily compensation of $67.26 from this credit until the Tenant vacates.
