What happened
The Landlord applied to terminate the tenancy because the Tenant seriously impaired the safety of other persons in the residential complex. Specifically, the Tenant repeatedly removed the smoke detector in the rental unit and covered the fire annunciator with a jacket. Despite receiving a warning letter and having the equipment replaced multiple times by Landlord staff, the Tenant continued the behavior. The Tenant did not attend the hearing.
The ruling
The tenancy continues on the condition that the Tenant (and their guests/roommates) does not remove or obstruct the smoke detector or fire annunciator for 12 months (August 1, 2025, to July 31, 2026). If these conditions are breached, the Landlord may apply for an ex parte eviction order. The Tenant is also ordered to pay the Landlord $186.00 for the application filing fee by August 11, 2025.
