What happened
The Landlord sought to terminate the tenancy because the Tenants breached a conditional order from April 2, 2025, by failing to pay $1,500.00 toward arrears. A subsequent eviction order was issued without a hearing. Tenant 2 filed a motion to set aside the order, which was initially denied. Tenant 2 then requested a review of that denial, claiming the previous adjudicator failed to consider his specific circumstances (license suspension) when determining if it was unfair to evict.
The ruling
The request for review is granted, and the order dated July 22, 2025, is cancelled. However, the motion to set aside the eviction order is denied because the Board found the tenancy is not financially viable. The stay of the eviction order (LTB-L-034114-25) is lifted effective October 15, 2025, allowing the Landlord to proceed with eviction.
