What happened

The Landlord applied to terminate the tenancy because the Tenant breached a conditional payment order issued on March 31, 2025. An ex parte eviction order was issued on June 17, 2025. The Tenant filed a motion to set aside that eviction order, claiming that payments were made but not reflected in the ledger due to postal interruptions. The Landlord maintained that the Tenant failed to pay rent in full and on time as required by the previous settlement.

The ruling

The Tenant's motion to set aside the eviction order was denied. The Member found the Tenant’s explanation for the breach (postal issues) not credible and noted a lack of supporting evidence. The stay of the eviction order issued on June 17, 2025, is lifted effective August 31, 2025, allowing the Tenant time to relocate while protecting the Landlord from further growing arrears.
