What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing, which the Landlord attended but the Tenant did not.
The ruling
Unless the Tenant voids the order by paying $2,910.80 on or before January 20, 2024, the tenancy will be terminated. If the Tenant does not void the order, the Tenant must move out by January 20, 2024. The Landlord is authorized to deduct $55.55 per day from the rent deposit and interest owed to the Tenant for the Tenant's continued occupation of the unit after December 18, 2023.
