What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants failed to pay the arrears specified in a valid N4 notice before the application was filed. Although the Tenants made a substantial payment of $8,055.00 after the application was filed, arrears remained at the time of the hearing.
The ruling
The tenancy is terminated effective July 5, 2025, unless the Tenants pay $2,864.85 by June 30, 2025, or $5,522.90 by July 5, 2025, to void the order. If the Tenants move out, calculations show that the Landlord actually owes the Tenants $783.09 because the rent deposit and interest exceed the arrears and fees owed as of the hearing date, though this credit is reduced by daily compensation of $87.39 for each day the Tenants remain past June 18, 2025.
