What happened
The Landlord applied for eviction due to non-payment of rent. The Tenant disputed the amount owing, claiming a payment for May 2025 was made via bank draft dropped in the Landlord's after-hours box. The Landlord denied receipt. The Adjudicator found that while the draft was purchased, receipt by the Landlord could not be confirmed, but granted a postponement of eviction to allow the Tenant time to replace the lost draft.
The ruling
The tenancy is terminated unless the Tenant pays $1,993.00 by October 31, 2025, or $3,949.72 by November 30, 2025. Eviction is postponed until November 30, 2025, to give the Tenant time to replace a lost bank draft for May 2025 rent. If the Tenant moves out, the Landlord actually owes the Tenant $560.23 (due to large payments and the deposit), subject to daily compensation deductions.
