What happened

Tenants applied for an order determining that the Landlord: (a) entered the rental unit illegally; (b) substantially interfered with the reasonable enjoyment of the rental unit or residential complex; and (c) harassed, obstructed, coerced, threatened or interfered with the Tenants. The Tenants are seeking various remedies including rent abatement, cease and desist orders, and general compensation.

The ruling

This is an interim order adjourning the hearing to a future date. The Tenants are directed to file a Tenant Affidavit and Tenant Documents Brief, and the Landlord is directed to file a Landlord Affidavit and Landlord Documents Brief. The Tenants may then file a Tenant Reply Affidavit and Tenant Reply Documents Brief. The admissibility of documents will be determined at the start of the hearing. The LTB has some concerns about its jurisdiction to grant certain remedies requested by the Tenants.
