What happened
The Landlord applied to terminate the tenancy and evict the Tenants due to significant rent arrears. The Tenants requested a three-month payment plan, but the Landlord objected, citing a history of broken promises and financial strain on his own savings. The Member found the Tenants to be evasive regarding their financial situation but determined they had sufficient surplus income to pay the arrears sooner than requested.
The ruling
The tenancy is terminated effective September 5, 2025, unless the Tenants pay $22,726.00 by August 31, 2025, or $28,661.00 by September 5, 2025, to void the order. If the Tenants do not void the order and fail to move out, they are ordered to pay the Landlord $11,702.91 (representing arrears to the hearing date minus the security deposit and interest) plus daily compensation of $195.12 from August 6, 2025, until they vacate.
