What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant admitted to the arrears but argued that he was withholding rent because of outstanding maintenance issues. However, the Tenant failed to comply with LTB Rule 19.4 by not providing a list of issues or evidence in advance, so the Board did not permit the maintenance issues to be raised. The Tenant claimed to have the funds available to pay.

The ruling

The tenancy is terminated effective August 11, 2025, unless the Tenant voids the order by paying the total arrears and costs. The Tenant must pay $6,036.00 by July 31, 2025, or $6,686.00 by August 11, 2025, to continue the tenancy. If the Tenant does not void the order, he must vacate by August 11, 2025, and pay the Landlord $5,248.88 plus daily compensation of $21.37 until moving out.
