What happened
The Landlord applied to evict the Tenants for personal use of the rental unit by his parents. The application was dismissed because the landlord failed to comply with a procedural requirement of the Residential Tenancies Act, 2006. Specifically, the affidavit filed in support of the application was signed by the Landlord himself, not by his parents who were the ones requiring the unit.
The ruling
The Landlord's application for eviction is dismissed. The tenancy will continue. The Tenants are ordered to pay the Landlord $2,500.00, representing the return of the compensation they received under section 48.1 of the Act.
