What happened

Tenants applied for an order determining that the Landlords gave a notice of termination in bad faith. The Landlords served the Tenants with an N12 notice stating they required the rental unit for their child's personal use. However, the Landlords later sold the rental unit within a month of the Tenants vacating.

The ruling

The Landlords failed to rebut the presumption of bad faith under section 57(5) of the Act. The Landlords must pay the Tenants $8,701.62, which includes rent differential for 9 months, moving expenses, and other remedies.
