What happened
Landlords applied to evict Tenants for non-payment of rent. The rent arrears exceeded the LTB's monetary jurisdiction of $35,000.00, but the Landlords chose to proceed, waiving their right to claim the full amount. The Tenants were absent from the hearing, with one appearing in the virtual room but being unresponsive. The Landlords provided evidence of severe financial hardship due to the unpaid rent.
The ruling
The tenancy is terminated unless the Tenants pay the full arrears of $41,586.00 by April 30, 2025, or $46,186.00 by May 11, 2025. If they fail to pay and do not move out by May 11, 2025, the Landlords can file for eviction. If the tenancy is terminated, the Tenants are ordered to pay the Landlords $35,186.00, which is the maximum jurisdictional amount plus the application fee, less the rent deposit and interest. Relief from eviction was denied due to the substantial arrears, the Tenants' unresponsiveness, and the severe financial hardship caused to the Landlords.
