What happened

The Landlord applied to terminate the tenancy and evict an Unauthorized Occupant because the Tenant transferred occupancy without consent. The Unauthorized Occupant had lived in the unit since September 2021, while the Landlord only discovered the unauthorized nature of the stay in September 2023 after noise complaints. Previously, the occupant had misled the property manager via email, claiming to be house-sitting during a motorcycle trip. Although the occupant moved belongings in May 2025, they did not return possession to the Landlord until June 2025.

The ruling

The LTB terminated the tenancy effective June 12, 2025. The Unauthorized Occupant is ordered to pay $7,995.02 in compensation for the use of the unit from September 11, 2023, to June 12, 2025, plus $201.00 for the application filing fee. Payments are due by December 20, 2025, after which interest will accrue.
