What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant due to substantial interference with the reasonable enjoyment or lawful rights of the Landlord and other tenants. The allegations included persistent dog barking, excessive noise (yelling, loud music, night-time construction), and allowing a dog to defecate and urinate on the balcony, causing waste to fall onto lower units and creating toxic smells from bleach cleaning. Despite receiving a notice to correct the behavior, the Tenant continued the conduct, resulting in dozens of further complaints from other residents.

The ruling

The Landlord and Tenant Board ordered the termination of the tenancy effective August 12, 2025. The Tenant is required to vacate the unit by this date and pay the Landlord $186.00 for the application filing fee. If the Tenant does not vacate, the Landlord is authorized to file with the Sheriff for eviction starting August 13, 2025.
