What happened
Tenant applied for an order determining that the Landlord collected or retained money illegally. The Tenant alleged that the Landlord failed to pay interest on the last month's rent deposit and also increased the rent illegally.

The Tenant proved the allegations in the application on a balance of probabilities. The Landlord must pay the Tenant $195.40, which includes $147.40 for interest on the last month's rent deposit and $48.00 for the cost of filing the application. The Landlord's rent increase in 2021 is deemed not void under section 135.1(1) of the Act.
