What happened

The Landlord applied to terminate the tenancy because the Tenant was persistently late in paying rent. Evidence presented showed the Tenant paid rent late 10 times out of a 13-month period. Even after the notice of termination was served, several subsequent months were paid late or remained unpaid by the hearing date. The Tenant claimed the lateness was caused by issues with automatic bank transfers and changes to the Landlord's contact information.

The ruling

The tenancy continues on the condition that the Tenant pays the $186.00 application fee by October 25, 2025, pays October 2025 rent by October 27, 2025, and pays all rent in full and on time for the next 12 months (November 2025 to October 2026). If the Tenant breaches any of these conditions, the Landlord may apply for an ex parte eviction order within 30 days of the breach.
