What happened
The Landlord filed for eviction due to non-payment of rent. The Tenant contested the N4 notice, claiming a rent payment for December 2024 was sent but was intercepted by a fraudulent email scam. The Tenant also filed a Section 82 claim regarding a broken dryer which the Landlord failed to repair for 30 days. The Board upheld the N4 but granted the Tenant's maintenance claim.
The ruling
The tenancy is not terminated. The Board granted the Tenant relief from eviction on the condition that she pays the outstanding arrears of $1,393.44 according to a four-month payment plan, in addition to paying her regular monthly rent on time. The Tenant also received a one-time rent abatement of $63.56 and an ongoing monthly abatement of the same amount until the Landlord repairs or replaces the broken dryer. If the Tenant defaults on the payment plan, the Landlord can apply for an eviction order without notice.
