What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, but the Tenant did not void the notice by paying the arrears. The Tenant was not present at the hearing.
The ruling
The Landlord's application for termination of tenancy was not granted due to a defect in the N4 Notice. However, the Landlord was allowed to amend the application to an L9 Application for arrears only. The Tenant was ordered to pay the Landlord $19,686, which includes $19,500 in rent arrears and $186 in application filing costs. If the Tenant does not pay the full amount by February 25, 2024, they will start owing interest at 7% annually on the outstanding balance.
