What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenant, claiming in good faith that the unit was required for residential occupation by the Landlord's parent for at least one year. The Landlord served an N12 notice on May 30, 2025. However, the Board found that the termination date provided in the notice (August 1, 2025) was incorrect as it did not fall on the last day of the rental period (July 31, 2025).

The ruling

The Landlord's application to terminate the tenancy for personal use is dismissed. The N12 notice was found to be defective because the termination date provided did not align with the end of the rental period as required by law.
