What happened
The Landlord applied to evict the Tenant for non-payment of rent. The Tenant attended the hearing, confirming they had already vacated the unit in March 2025, but only notified the Landlord via text on April 8, 2025. The Tenant had raised s.82 issues but chose to pursue them in a separate application. The Board proceeded to determine the rent arrears owed up to the date the Tenant was deemed to have vacated.
The ruling
The tenancy is terminated effective April 8, 2025, the date the Tenant was deemed to have vacated the unit. The Tenant is ordered to pay the Landlord $8,157.21, which covers rent arrears up to the move-out date plus the application fee, with a deduction for the rent deposit and accrued interest. Interest will be applied to any unpaid balance after May 9, 2025.
