What happened
Tenants applied for an order determining the Landlord substantially interfered with their enjoyment of the unit and harassed them. They alleged they were induced to sign an N11 termination agreement based on a false representation that the property was being sold, only for the unit to be re-listed at a higher rent shortly after they vacated. They also alleged an unlawful rent increase attempt and maintenance issues regarding a shower drain.
The ruling
The Tenants' application was dismissed in its entirety. The Board found no evidence of harassment or bad faith. The tenancy was terminated by mutual agreement (N11), and the Landlord's son's conduct was found to be professional. The Landlord's explanation for re-listing the unit after a failed sale attempt was accepted.
