What happened
The Tenants filed an application claiming the Landlord issued an N12 notice for personal use in bad faith. After vacating the unit, the Tenants discovered the Landlord had renovated the property and was operating it as an AirBnB. Evidence showed the unit was advertised for rent at a higher rate than what the Tenants were previously paying.
The ruling
The LTB found the Landlord acted in bad faith by evicting the Tenants under the guise of personal use and then listing the unit as an AirBnB. The Landlord is ordered to pay the Tenants a total of $13,629.90, which includes a one-year rent differential of $6,120.00, moving expenses of $403.90, general compensation of $7,000.00, and the filing fee.
