What happened

The Tenants applied for an order determining the Landlord gave a notice of termination in bad faith. After several procedural steps, including a previous review and a de novo hearing where the Landlord was absent, an order was issued in favor of the Tenants. The Landlord then requested a review of that order, claiming he did not receive the Notice of Hearing for the May 13, 2025 hearing.

The ruling

The Landlord's request for a review of the order dated June 27, 2025, is denied. The Adjudicator found that the Landlord likely received the notice of hearing and, even if there were issues with his brother receiving the initial digital notifications, the Landlord failed to act with the required diligence to stay informed about the case. The stay of the previous order is lifted immediately.
