What happened
The Landlord applied to terminate the tenancy and evict the Tenant for non-payment of rent. The Tenant admitted to the arrears, citing financial difficulties, and requested a payment plan. However, a review of the Tenant's finances showed that their monthly expenses exceeded their income, making a payment plan unsustainable. The Landlord sought a standard order. The Member granted the eviction but provided a short postponement for the Tenant to find alternate housing, as they provide childcare for two children.
The ruling
The tenancy is terminated effective September 19, 2025. The Tenant must pay $5,888.55 to the Landlord for arrears up to the hearing date and the filing fee, after deducting the rent deposit and interest. The Tenant can void the eviction by paying a total of $10,231.00 (which includes September rent) on or before September 19, 2025. If the Tenant fails to pay or move out, the Landlord may enforce the eviction through the Sheriff on or after September 20, 2025.
