What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to substantial interference with the reasonable enjoyment of the residential complex. The Tenant repeatedly tampered with the breaker box, shutting off electricity and air conditioning for the upstairs tenants to regulate his own temperature. The Landlord sought a conditional order allowing the tenancy to continue provided the behavior stopped, citing the Tenant's age as a factor for leniency.

The ruling

The tenancy continues on the condition that the Tenant does not touch or tamper with the breaker box in the rental premises. The Tenant is ordered to pay the Landlord $186.00 for the application filing fee by July 8, 2025. If the Tenant breaches the condition regarding the breaker box, the Landlord may apply for an eviction order without further notice to the Tenant within 30 days of the breach.
