What happened

Landlord applied to terminate the tenancy and evict Tenant for non-payment of rent. During the proceedings, it was disclosed that Tenant had filed a consumer proposal and subsequently for bankruptcy. The adjudicator determined that under the Bankruptcy and Insolvency Act, the LTB proceedings regarding rent arrears and eviction based on those arrears must be stayed.

The application for eviction and rent arrears is stayed due to the Tenant's bankruptcy filing under the Bankruptcy and Insolvency Act. The stay remains in effect until a court order specifies otherwise or the Tenant is discharged from bankruptcy.
