What happened
Tenant applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 or failed to comply with health, safety, housing or maintenance standards. The Tenant claimed his personal property was damaged as a result of two floods in the house, due to the failure of the Landlord to respond in a timely manner or to keep the unit in proper repair.
The ruling
The Landlord must pay the Tenant $3,848.00, which represents $3,800.00 for the reasonable costs the Tenant incurred to repair/replace the property damaged due to the Landlord's failure to maintain the unit, and $48.00 for the cost of filing the application. If the Landlord does not pay the full amount by November 9, 2024, the Landlord will owe interest at 6.00% annually on the outstanding balance.
