What happened

The Landlords applied to terminate the tenancy because they require the rental unit for their elderly parents to live in. The Tenant questioned the good faith of the application, citing a previous withdrawn N12 notice and the Landlord sharing high market rent listings. A preliminary issue arose regarding whether the mandatory one-month compensation was provided, as the Landlord claimed it was mailed with the notice while the Tenant denied receiving the cheque.

The ruling

The tenancy is terminated effective May 31, 2025. The Landlords' application for personal use by their parents was found to be in good faith. The Landlords are ordered to pay the Tenant $1,446.70 as the required one-month compensation by April 25, 2025, as the previous cheque was purportedly lost in the mail.
