What happened
The Landlord applied for termination of the tenancy and eviction due to significant rent arrears. The Tenants had previously requested an adjournment due to health issues (surgery) and intended to raise section 82 issues. However, an interim order required the Tenants to pay ongoing rent and file their claims, which they failed to do. The Tenants did not attend the final hearing.
The ruling
The tenancy is terminated effective October 14, 2025. To void the eviction and continue the tenancy, the Tenants must pay $26,586.00 by the termination date. If they do not pay and do not move out, the Landlord can enforce the eviction through the Sheriff on or after October 15, 2025. If the tenancy is terminated, the Tenants are ordered to pay the Landlord $21,865.22, plus daily compensation of $78.90 until they vacate.
