What happened

The landlord applied to terminate the tenancy and evict the tenant due to the tenant seriously impairing the safety of others and wilfully causing undue damage to the rental unit. The landlord submitted evidence that the tenant tampered with the smoke detector and stove, posing a serious safety risk. However, the landlord did not provide sufficient evidence to prove the tenant caused wilful damage to the rental unit.

The ruling

The tenancy is terminated effective January 16, 2023. The tenant must vacate the unit by this date. The tenant is ordered to pay the landlord $3,398.61, which includes compensation for use and occupation of the unit and the landlord's application filing fee. If the tenant does not pay the full amount by January 16, 2023, they will owe interest at 5% annually on the outstanding balance starting January 17, 2023.
