What happened
The Landlords applied to terminate the tenancy and evict the Tenants due to significant rent arrears. The Tenants attempted to raise maintenance and harassment issues at the hearing but were barred from doing so because they failed to properly serve their evidence to the Landlords in accordance with LTB disclosure rules. While the Tenants claimed some individuals had vacated, the Member found it to be a joint tenancy. The Tenants were granted a brief postponement of eviction due to financial hardship but were ordered to pay arrears and vacate by November 30, 2025.
The ruling
The tenancy is terminated effective November 30, 2025. The Tenants are ordered to pay $7,162.62 to the Landlords for arrears and the filing fee, after deducting the rent deposit and interest. To void the eviction and continue the tenancy, the Tenants must pay $10,386.00 by October 31, 2025, or $12,936.00 by November 30, 2025. Daily compensation of $83.84 applies for each day the Tenants remain past the hearing date.
