What happened
Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and for seriously impairing the safety of the Landlord. The Landlord served valid N4 and N7 notices, but the Tenant did not void the N4 notice by paying the rent arrears or attend the hearing.
The ruling
The tenancy is terminated effective May 14, 2023. The Tenant must pay the Landlord $3,235.16, which includes rent arrears up to the hearing date and the application filing fee, minus the rent deposit and interest. The Tenant must also pay daily compensation of $37.05 from April 26, 2023 until the date they move out. If the Tenant does not pay the full amount by May 14, 2023, they will owe interest at 6% annually on the outstanding balance.
