What happened

The Landlords applied to terminate the tenancy and evict the Tenants due to rent arrears. Although the Tenants failed to void the initial N4 notice, they made significant payments totaling $12,450.00 after the application was filed. By the hearing date, the parties agreed the remaining rent arrears were only $150.00. The Board considered whether to grant relief from eviction given that the debt was almost entirely settled.

The ruling

The application for eviction was denied. The Board granted the Tenants relief from eviction because the arrears were substantially paid after the application was filed. The Tenants are ordered to pay the remaining balance of $135.64 to the Landlords by November 15, 2025. This balance includes the filing fee and remaining arrears, minus a credit for interest owed on the rent deposit.
