What happened

The landlord applied for an order to terminate the tenancy and evict the tenants due to their failure to pay rent as required by a previous LTB order. The tenants did not meet the condition in the previous order to pay the rent for May 2023 by the due date.

The ruling

The tenancy is terminated effective June 5, 2023. The tenants must pay the landlord $3,229.12, which includes the outstanding rent arrears from the previous order and new arrears for May 2023, less the rent deposit and interest. The tenants must also pay the landlord $79.02 per day for use of the unit starting May 26, 2023 until they vacate.
