What happened

The Landlord applied for termination of tenancy and eviction because Tenant 1 failed to pay the rent. Although Tenant 1 made significant payments totaling $5,040.00 since the application was filed, a balance remained. Tenant 1 did not attend the hearing to provide personal circumstances. The Landlord sought a standard order as Tenant 1 did not respond to attempts to negotiate a repayment plan.

The ruling

The tenancy is terminated effective September 2, 2025, unless the Tenant voids the order by paying $930.93 by August 31, 2025, or $2,603.86 by September 2, 2025. If the tenancy is terminated, calculations show that the Landlord actually owes the Tenant $1,686.50 because the rent deposit and interest exceed the arrears and filing fee, though the Landlord may deduct $55.00 daily compensation for each day of occupation starting August 14, 2025.
