What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent and persistent late payment of rent. The Landlord served the Tenant with valid N4 and N8 notices, but the Tenant did not void the notices by paying the arrears or remedying the persistent late payments.

The ruling

The tenancy is terminated unless the Tenant pays $23,182.27 by December 16, 2023 to void the order. If the Tenant does not pay, they must vacate by December 16, 2023 and pay $19,889.51 to the Landlord. The Landlord's application for persistent late payment was dismissed.
