What happened
The Landlord applied to terminate the tenancy and evict the Unauthorized Occupant because the original Tenant had passed away and the occupancy was transferred without consent. The rental unit is located in a non-profit housing complex designated specifically for seniors. The Unauthorized Occupant, who was previously the Tenant's caregiver, claimed to be a tenant after making some partial payments and having conversations with a former property manager. However, the Board found no valid tenancy agreement existed and that the Occupant did not meet the senior age requirements for the complex.
The ruling
The LTB ordered the termination of the tenancy effective January 27, 2024. The Unauthorized Occupant must vacate the unit by September 28, 2025. The Occupant is ordered to pay $25,503.45 in daily compensation for the period of unauthorized use, plus the $201.00 filing fee and ongoing daily compensation of $47.67 until vacating. The Board denied relief from eviction, citing the building's specific mandate to serve seniors on a waitlist.
