What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant attempted to raise maintenance issues under section 82 but was barred due to insufficient disclosure. The Tenant admitted to withholding rent due to maintenance issues but sought a payment plan to preserve his 15-year tenancy. There was also a dispute regarding a last month's rent deposit, which the Tenant claimed was paid in cash 15 years ago to a previous owner.
The ruling
The Tenant is ordered to pay $5,436.00 in arrears and costs through a scheduled payment plan. This includes a lump sum of $3,500.00 plus the October rent by October 10, 2025, followed by monthly installments of $200.00 plus regular rent. If the Tenant fails to meet any payment, the Landlord can apply for an ex parte eviction order under section 78 of the Act.
