What happened

The landlord applied for an order to terminate the tenancy and evict the tenant due to non-payment of rent and persistent late payment of rent. The landlord served the tenant with a valid N8 notice for persistent late payment of rent, and the tenant remained in possession of the rental unit at the time of the hearing.

The ruling

The tenancy is terminated effective May 21, 2023. The tenant must pay the landlord $1,425.64, which includes rent arrears, application filing fees, and NSF charges, less the last month's rent deposit and interest. The tenant must also pay the landlord $19.71 per day for use of the unit starting April 20, 2023 until the tenant moves out. If the tenant does not pay the full amount by May 21, 2023, the landlord may file the order with the Court Enforcement Office for eviction.
