What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The Tenants requested a review of the order, claiming they were unable to participate in the initial hearing due to technical difficulties and illness.
The ruling
The Tenants' request for review was granted on the basis that they were not reasonably able to participate in the initial hearing. A de novo hearing was conducted, and the Board found that the Tenants had not made any rent payments since the start of the tenancy and had accumulated over $21,000 in rent arrears. The Board determined that it would be unfair to grant relief from eviction and ordered the tenancy terminated unless the Tenants paid the full amount owing by September 22, 2024.
