What happened

The Landlord applied for termination and eviction after the Tenant allegedly breached a previous LTB order. An ex-parte order was initially issued but the Tenant filed a motion to set it aside. During the motion hearing, the parties reached a consent agreement regarding rent arrears, utility costs, and a structured payment plan to maintain the tenancy.

The ruling

On consent, the Board set aside the previous eviction order and established a new payment plan. The Tenant is ordered to pay $1,148.00 in utilities by October 31, 2025, and $19,901.45 in rent arrears over two installments ($10,000.00 by November 14, 2025, and $6,506.45 by December 15, 2025). The Tenant must also pay monthly rent of $3,395.00 on specific dates. Failure to meet any payment condition permits the Landlord to apply for an ex-parte eviction order within 30 days of the breach.
