What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to significant rent arrears totaling over $10,000. The Tenant admitted to the arrears and cited job loss as the cause, requesting a conditional payment plan and an extended move-out date. The Tenant also attempted to raise Section 82 issues related to maintenance or tenant rights, but this was disallowed by the adjudicator because the Tenant failed to provide the required written notice to the Landlord and the Board prior to the hearing.

The ruling

The tenancy is terminated effective May 12, 2025, unless the Tenant voids the order by paying $12,382.00. If the Tenant does not void the order, he must vacate by the termination date and pay the Landlord $8,566.99, representing arrears and the filing fee minus the rent deposit and interest. Daily compensation of $55.86 is required for each day the Tenant remains in the unit after the hearing date.
