What happened
The Landlord initially obtained an eviction order for non-payment of rent. The Tenant requested a review, claiming he was unaware of the original hearing. While the Board found the Tenant lacked diligence in checking his mail and email, a review of the file revealed an error of law: the N4 notice was served after the termination date, making it invalid for eviction. Consequently, the eviction was cancelled, but the Tenant was ordered to pay the substantial rent arrears.
The ruling
The request for review is granted, and the original eviction order is cancelled due to an invalid N4 notice. However, a new order is issued requiring the Tenant to pay $10,788.00 in rent arrears and filing costs to the Landlord by August 3, 2025. No eviction is ordered at this time.
