What happened

The Tenant requested a review of a previous order, claiming he was unable to participate and that the order contained serious errors regarding the lawful rent and rent deposit. The Landlord and Tenant had an agreement where the Tenant performed maintenance tasks in exchange for a rent reduction. The main dispute concerned whether the base rent was $1,150.00 or $1,050.00. The Board found that failing to allow evidence on these central issues in the previous hearing was a serious error. After hearing evidence, the Board determined the base rent was $1,150.00 and calculated the arrears owing to the Landlord.

The ruling

The LTB varied the previous order to reflect a base rent of $1,150.00. The Tenant is ordered to pay the Landlord $8,738.69 by October 20, 2025. This amount accounts for rent arrears through September 30, 2025, and the application filing fee, minus payments and a specific agreed-upon credit. If the Tenant fails to pay by the deadline, interest will accrue at 4% annually.
